GEMSYS MONEY HANDLING SYSTEMS INC
LIMITED WARRANTY TERMS
1. Gemsys Money Handling Systems Inc (Gemsys) warrants that its products will be free of defects in material and workmanship. The warranty shall not apply to repair of damage from shipment (which is the carrier’s responsibility) or of damage or defects arising as a result of misuse, unauthorized repair, neglect, alteration, accident or use of supplies or consumable items that do not meet Gemsys minimum specifications. Expandable parts (consumable items) such as fuses, lamps, pads, belts, rollers, and operating supplies are excluded from this warranty.
2. Under this warranty, Gemsys, at its expense, will repair or replace any defective parts shipped to Gemsys, freight prepaid, by the customer. Gemsys will deliver the appropriate repaired or replacement part to the customer freight pre-paid. This means that Gemsys does not reimburse any third party for any labour charges. Instead of shipping the equipment to Gemsys for warranty repair, an authorized full service dealer may elect to order replacement parts for warranty replacement and perform any warranty repair at his expense. Defective parts must be returned to Gemsys along with proof of model and serial numbers.
3. This warranty is in lieu of, and Gemsys excludes all other express or implied warranties, including without limitation, any warranty merchantability or of fitness for a particular purpose.
4. Gemsys sole liability and customer’s exclusive remedy for any claim, whether in tort, contract, strict liability or otherwise, be limited to the repair or replacement of defective parts pursuant to the warranty described above and in no event shall Gemsys be liable to its customer for any damages, direct indirect, or consequential, whether in tort contract, strict liability, or otherwise, arising out of or resulting from the furnishing of products hereunder, or be liable for any contribution or indemnification. In no event will Gemsys liability exceed Gemsys sale price for the defective product.
